Terms & Conditions of Engagement

This document serves to establish a clear and respectful understanding between the client (referred to herein as “you”) and DJ Josh Peverley (referred to as “the Operator”), outlining the scope, responsibilities, and expectations associated with the provision of bespoke musical entertainment services.

These terms become binding upon confirmation of a formal booking, which consists of a signed agreement and receipt of the initial booking fee.

1. Engagement Overview

The Operator shall deliver a curated musical experience via professionally engineered audio equipment and, where agreed, atmospheric lighting and subtle narration. The location of the event (the “Venue”) and the date of service (the “Performance Date”) shall be confirmed upon booking. You agree to provide sufficient access to the Venue, including a minimum of 90 minutes for installation and 60 minutes post-event for safe dismantling.

2. Booking Confirmation & Payments

To secure your booking, a non-refundable deposit amounting to 25% of the total performance fee is required. This may be remitted via BACS, cheque, or cash during a consultation. The balance is due no later than 14 days prior to the Performance Date, unless otherwise agreed in writing.

Once the deposit has been received and the Booking Agreement signed, your event date is officially reserved and governed by these terms.

3. Cancellation Policy

I understand that circumstances may change. Should you choose to cancel:

• Within 30 days of the event: 50% of the total fee is payable.
• Within 14 days of the event: 100% of the total fee is payable.

In the rare instance the Operator is unable to fulfil the booking, a suitable high-calibre replacement will be provided at no additional cost, or a full refund offered at your discretion.

Should governmental restrictions (e.g., due to COVID-19) impede your event, you may transfer your booking to a future date, subject to availability.

4. Timeliness of Payments

Failure to provide full payment by the agreed date may result in cancellation of services, and any monies paid may be retained. Any alternative payment arrangements must be agreed in advance and confirmed in writing.

5. Performance Adjustments

• Extension: Any extension to the scheduled performance time must be arranged in advance and may incur additional fees, in line with venue licensing regulations.
  
  
• Reduction: Should the Operator’s performance be delayed due to factors beyond your control, a partial refund may be offered on a pro-rata basis. However, delays resulting from insufficient access time or venue restrictions will not be eligible for refund.

6. Event Customisation

Clients are welcome to submit music preferences up to 5 days prior to the event. While every effort will be made to honour your requests, the Operator retains artistic discretion to curate a seamless and engaging atmosphere.

Any bespoke audio files must be provided at least 7 days in advance via USB or secure digital transfer (e.g., WeTransfer, Dropbox).

7. Professional Conduct

The Operator and any accompanying personnel will maintain the highest standards of professionalism, including attire suited to the nature of your event. Specific dress code preferences must be indicated during booking.

You, as the host, are responsible for the conduct of your guests. The Operator reserves the right to terminate the performance without refund if any form of abuse or threatening behaviour occurs.

8. Access & Installation

You must ensure appropriate access to the Venue for setup and breakdown. If access is limited (stairs, no lift, restricted parking), please inform the Operator in advance to avoid delays or additional charges.

9. Supervision & Safety

Adequate adult supervision must be provided for all guests under the age of 18. Children must be kept away from all technical equipment. Assistance from supervising adults may be requested during interactive entertainment (e.g., games).

10. Insurance & Certification

Public and Employers Liability Insurance certificates, as well as PAT testing documentation, are available upon request and downloadable via the Operator’s official website.

11. Venue & Equipment Integrity

It is the client’s responsibility to ensure the Venue is fit for purpose. Should the environment pose a health or safety risk — such as unstable structures or unsafe marquees — the Operator reserves the right to withdraw from performance, with the full fee still applicable.

The Operator will provide all required sound and lighting equipment, and specialist effects upon request (subject to availability and venue approval). Equipment is strictly for Operator use and not available for third-party handling unless agreed.

12. Use & Interference of Equipment

Only the Operator and approved personnel may install and operate the provided equipment. The Operator accepts no liability for damages or injuries arising from unauthorised interference.

13. Sound & Visual Considerations

The Operator shall not be held responsible for sound restrictions imposed by sound limiters at the Venue. Clients are encouraged to confirm such restrictions with the Venue and inform the Operator in advance.

The Operator cannot accept liability for any reactions caused by sound, strobe, smoke, or other lighting effects. Please notify the Operator of any sensitivities in advance.

14. Health & Safety Protocols

All equipment is maintained in line with current Health & Safety legislation. The Operator will make every effort to assist in emergency evacuation procedures where possible.

Damage to the Venue caused by guests remains the responsibility of the client.

15. Final Provisions

These Terms & Conditions may only be amended in writing by mutual agreement. Bookings may not be transferred to another host or entity without express consent from the Operator.

The Operator reserves the right to decline bookings without obligation to provide a reason. Clients under 18 must have a legal guardian or representative complete the booking form.
